Our State Legislature decides what is a “crime” in Utah. To punish crimes, the legislature generally orders jail/prison time or orders you to pay a fine. You have Constitutional rights to protect yourself. If the Government can’t prove you committed the crime, without violating your rights, then they usually don’t have enough evidence against you and the case is usually dismissed. That’s how our justice system works, or is supposed to work. The problem is that many people charged with crimes don’t assert all of the rights they are granted, which makes it easy for the Government to force people into paying expensive fines and serving jail time.
Your Constitutional Rights
The constitution allows us to protect ourselves from our own Government (e.g. Right to a jury trial, Right to Testify, etc.). The most important right we can assert is our Right to be Represented by an Attorney. Having a knowledgeable criminal defense attorney who can force the government into proving every part of their case against you is the best chance you have at getting the case dismissed, or the sentenced lowered so that it is more reasonable for you and your family’s situation.
Finding the Right Attorney
Unfortunately, there are attorneys who try to get rich off of your tragic situation. It’s easier for someone who knows very little about the law to trust someone who knows a lot. But while someone who knows the law may be happy to take your money, they may not be willing to fight for you in court. Some even misrepresent the law to their clients to encourage their cooperation. Seeing so many of these situations is what motivated me to attend law school and work with people who need help navigating legal situations.
It is important that the attorney you hire cares about you and your situation. If not, then you may have been better off not hiring a lawyer at all.
