Utah Family Law: Separation, Divorce, Custody
Utah courts define “marriage” as a contractual relationship between two people, creating a marital estate. Thus, divorce and separation are treated very similar to the dissolution of a business or partnership.
A Divorce Decree becomes a court order that all parties are required to follow. In these difficult situations, it’s easy to have ill feelings for the parties on the other side. In my experience the attorneys who focus on creating an agreement that is a good deal for everyone get better results for their clients. I avoid focusing on “getting even,” or making life difficult for the other side.
Child Custody issues are very similar, except that Utah law focuses on the “best interests of the child.” Many times a loving and caring parent is deprived of important parenting time because their ex-spouse’s lawyer manipulated their case. It’s not uncommon for a change or amendment in a parental custody order to be in the “best interests of the child,” and a caring attorney can help you make that change.
In some areas of law the choice of which lawyer you have represent you may not have a drastic impact on the outcome of your case. In family law issues, the choice of a lawyer is critical. Don’t hire someone because they promise to vigorously uphold your divorce and parental rights. Hire a lawyer who can help you understand what your rights and options are while working diligently with the other parties on an agreement that makes everyone happy.
